SC grants bail to Mother whose 7-8 months child is also staying in jail with her

The SC on June 02, 2020 {NEHA SINGH vs STATE OF GUJARAT & ANR.} held that pending further consideration, the petitioner shall be released on interim bail, subject to the satisfaction of the Trial Court. It was held that the Trial Court may impose such conditions as it deems appropriate. 

It was submitted before the Bench, comprising of Justice UDAY UMESH LALIT, Justice MOHAN M. SHANTANAGOUDAR and Justice VINEET SARANthat the petitioner has a child of 7 to 8 months old and since the petitioner is in jail, the child is also staying with her mother in jail. In view of the peculiar circumstances, the interim bail was granted ex-parte by the SC, while issuing notice, on the very first date, when the SLP was listed for consideration. 

In the present case, the order rejecting bail application in FIR registered under Sections 406, 420 and 120-B IPC and under Sections 66C, 66D of the Information Technology Act, 2000, was under challenge in the special leave petition before the SC.
