Murder Convict gets bail from the Top Court, has undergone 13 years of Sentence

The SC on June 15, 2020 {NANDAKISHORE & ORS. v. THE STATE OF MAHARASHTRA} held that after considering the material on record and after hearing the learned counsel for the petitioner and the learned Additional Advocate General for the State of Uttar Pradesh, the Court is of the considered view that the petitioner is entitled for release on bail.

The SC Bench, comprising of Justice L. NAGESWARA RAO & Justice S. RAVINDRA BHAT, further observed that there is no dispute of the fact that the petitioner has already undergone a sentence of 13 years.

The petitioner was convicted for an offence under Section 302 of the IPC and under Section 25 of the Arms Act and sentenced to life imprisonment by Session Court.The appeal filed by him against the conviction and sentence is pending in the High Court. The Second Bail application preferred by him during the pendency was rejected by the HC against which the petitioner had filed this Special Leave Petition before the SC - which stood allowed as aforesaid.

The petitioner was directed to be released on bail subject to the satisfaction of the Trial Court.
