Employee is entitled for bail, when Chairman has already been enlarged on bail; Supreme Court

The SC on May 12, 2020 {NANDAKISHORE & ORS. v. THE STATE OF MAHARASHTRA} held that in spite of the bail application being opposed by the State, the Court is of the considered view that the petitioners are entitled for bail as Ratnakar Manikrao Gutte, the Chairman of the Gangakhed Sugar Factory has already been granted the benefit of bail by the Court on 5.3.2020.

The SC Bench, comprising of Justice L. NAGESWARA RAO, Justice S. ABDUL NAZEER & Justice SANJIV KHANNA further held that the petitioners are employees working in the sugar factory and have been in jail since 20.02.2018. It was held that Charges have been framed. It was observed that as the Chairman of the Sugar Factory has been released on bail, the petitioners are also entitled for bail. The SC held that the petitioners are directed to be released on bail.

However, it was directed by the SC that the petitioners shall not handle the documents of the sugar factory in any manner connected to the present case.
