Criminal Lawyer: Merely being relative of the victim does not make the witness - interested witness; SC.

In the case titled as "Sadayappan Vs. State", the SC has reiterated that a witness cannot be said to be an interested if he/she is a relative of the victim. The witness may be called interested if he/ she derives some benefit from the result of litigation out of the decree in a civil case, or in seeing an accused person punished.

In the said case the sentence of life awarded to the appellant was confirmed for murder based on circumstantial evidence.
