Criminal Lawyer: In case of conviction for more than one offence, sentences to run concurrently - unless otherwise directed ; SC.

Supreme Court of India

Justice A.M Khanwilkar

The SC has held that if the accused is convicted for more than one offence at the time, the sentence is to run concurrently, unless otherwise directed.

It was further held in "Rajan Vs Home Secretary", for remission only those offences were to be considered, which are pending to be served, those offences of which imprisonment has been completed by the convict, cannot be taken for consideration, while considering the case of the convict for remission by appropriate government. In the said case the Writ Petition was filed under Art 32 directly before the SC which was disposed in above said terms.
