Supreme Court of India

Justice R Banumathi

The Supreme Court of India in the case titled as "Govind Singh versus State of Chhattisgarh", has modified the judgement of the Chhattisgarh High Court by converting the sentence of life imprisonment under Section 302 IPC to one under Section 304 part II IPC.

It was held by the court that as the quarrel between the father and the daughter was on spur of movement, at which accused / father threw Chimney lamp on her daughter, who had succumbed to her injuries after 7 days due to that. Therefore, the offence falls under Section 304 part II IPC, not under Section 302 IPC. The sentence was modified of the accused / appellant from life imprisonment to the period already undergone, that is, 11 years and eight months.
