Condition of deposit imposed for grant of bail by the HC shall not be insisted upon; SC.

The SC on April 08, 2020 {SRIKRUSHNA PADHI v. REPUBLIC OF INDIA} held that  the petitioner has made out a case for release on bail without insisting on the condition for depositing the amount as contained in the order of the High Court. It was directed that let the petitioner be released on bail. 

It was the case of the petitioner that he has already been in custody for about seven years and the maximum sentence is ten years and the petitioner is unable to comply with the conditions since his entire property has been attached by the Enforcement Directorate. In view of that, the condition imposed for deposit by the HC for grant of bail was dispensed with by the SC. 

In the present case, the High Court has already granted bail to the petitioner with a condition to deposit certain amount. An application was filed by the petitioner for modification of condition did not find favour with the HC in the impugned judgment. The SLP was disposed of by dispensing the condition of deposit by the SC as aforesaid.
