SC extends the tenure of Chairperson of TDSAT for three months.

Supreme Court of India

JUSTICE L. NAGESWARA RAO, JUSTICE SANJAY KISHAN KAUL & JUSTICE DEEPAK GUPTA

The SC on April 07, 2020 {KUDRAT SANDHU v.UNION OF INDIA & ANR.} held that it is concerned regarding appointments of Administrative Member(s) and Technical Member(s) not being made after they have fallen vacant long back. It was held that the tenure of the Chairperson of TDSAT is extended for a period of three months from the date of expiry of his/her tenure i.e. 20.04.2020.

In the present case, interim application was filed before the SC in Writ Petition, seeking a direction to the respondents to make appointments to the posts of Member(s) and that the tenure of the Chairperson of Telecom Disputes Settlement and Appellate Tribunal (for short, the ‘TDSAT’) which is coming to end on 20.04.2020 be extended. The direction was passed by the SC, extending the tenure for three months, and it asked the SG to take instructions by next date regarding steps taken by govt. for appointment(s) on vacant posts.
