An appellant has already undergone 101 days, out of one year sentence, SC grants bail pending appeal

The SC on June 03, 2020 {K. KISHAN REDDY vs THE STATE, ANTI CORRUPTION BUREAU (ACB)} held that the accused-applicant/appellant has already undergone 101 days of sentence, out of total sentence period of one year.

It was held by the Bench, comprising of Justice A.M. KHANWILKAR, Justice DINESH MAHESHWARI and Justice SANJIV KHANNAthat despite vehement objection taken by learned counsel for the State, in the fact situation of the present case, it is inclined to grant bail to the accused-applicant/ appellant, who had availed of bail during the pendency of the appeal before the High Court.

Accordingly, while allowing the application, the SC ordered that during the pendency of the appeal, the accused- applicant/appellant is directed to be released on bail to the satisfaction of the Trial Court.
