It was held by the Supreme Court in "Raja Singh and Another Versus State of UP and another" that the high court committed serious error of law while denying the relief to the appellants.

It was held that the appellants were appointed prior to coming into force of the UP Minority Welfare Department Gazetted officers Rules 2001, therefore, the appellants were directed to be considered to be absorbed in Minority Welfare Department and they were held entitled for continuation of service, and those who had retired - for retirement benefits as per rules.
