Service lawyer: the requisite academic qualification is indispensable for appointment; SC.

It was held by the Supreme Court in the case titled as "Maharashtra Public Service Commission versus Sandeep", that the requisite academic qualification, with requisite number of practical experience in the manufacturing of drugs, were essential qualification; and Research experience in a research and development laboratory was a desirable qualification, which may have entitled such a person to preference only as per the advertisement for the post.

In the said case the high court committed serious error of law, while allowing the respondent to be considered eligible who was having research experience, but was not having the requisite essential requirements for the appointment as per the advertisement. Accordingly, the High Court judgement was set aside.
