Labour and Industrial dispute lawyer: pay scale was revised retrospectively, the employees were held to fall in Group C; employer appeal was allowed.

Supreme Court of India

Justice M R Shah

The Supreme Court of India in the case titled as "Regional manager versus Maslauddin" has set aside the concurrent findings of the labour court and the High Court.

The Supreme Court of India has held in para number 8.4 of the said judgement that as the pay scale of the employees was revised retrospectively, therefore, the employees were held to fall in Group C, for which the age of superannuation was 58 years.

The relief granted to the Employees, in respect of their contention in falling in in another group, in which the age of superannuation was higher, by the lower courts, was set aside, as the same was without the authority of law and illegal.
