Rent control corporate lawyer: the statutory tenant cannot be evicted even if the person who has inducted him has interest only for his life in the tenanted premises; SC.

Supreme Court of India

Justice D Y Chandrachud

The Supreme Court of India in the case titled as "Dr R S  Grewal and others Versus Chandra Prakash" has held that the statutory tenant has right to continue, even if the person who has inducted it, has only interest in the property for its life, even after the death of that person/ landlord. Even if the person/ landlord is not absolute owner, then, also the tenant has right to continue.

It was further held that the protection accorded to the tenant is by virtue of rent control legislation, therefore, it would not make any difference; that the person who had inducted tenant only had the life interest or is not absolute owner of the tenanted premises.
