In the case titled as "Gurdev Singh and others Versus Union of India and others" the issue falling consideration before the apex court was the allotment of land to the migrant in the year 1985 which offer stood lapsed on account of non deposit of amount in 30 days.
In the present matter the allottee challenged the valuation of property before the court in the year 1985 and for that reason had not deposited the amount within the prescribed period of time. As the allotment was of the year 1985 and the appellant was fighting the case since then, in view of peculiar facts and circumstances, the supreme court directed the Union of India to execute sale deed in favour of the migrant by directing him to pay near about price of market value of the plot. The order of the division bench of the High Court was accordingly set aside. The Appeal was allowed.
