Corporate Lawyer: Penalty of five times the fees imposed on college for taking admissions beyond permissible limit: SC.

The SC {Fore School of Management vs AICTE} had affirmed imposition of penalty of Rs. 23 Crores Ten Lakhs by AICTE on the management institute for admitting extra 42 students, without permission/ increase in seats. 

It was held that the AICTE has no discretion to award a lesser penalty than the one prescribed under the rules. It was further held infact the petitioner has been let off lightly, since only penalty has been imposed, whereas the AICTE could have imposed more than one penalty prescribed. The institute was directed to pay balance penalty of Rs. 19,10,00,000/- within eight weeks. As per the rules, inter alia, there is penalty of five time the fees received from students, for admitting students over the permitted number.
