Corporate Lawyer: limitation act is only applicable to the proceedings in the court, and not before the Quasi judicial body, unless expressly provided; SC.

Supreme Court of India: (Justice Ashok Bhushan) In the case titled as "Ganesh versus Commissioner Tamil Nadu Charitable Board", it was held by the SC that the special or local law can make applicable limitation act or part of it, only by statutory scheme, and only that part of the limitation Act shall be applicable qua proceedings which are carried on before authority which is not the court, as which has been made applicable by the scheme. It was held that the limitation act is only applicable to the proceedings in the court, and therefore, the order of the High Court was set aside, as the appeal filed before the commissioner was time barred, and there is no applicability of the limitation act due to aforesaid.
